32 - Thomas Webb Edge of Notts. to Francis Hurt, inconsideration of payment of legacies of £4,000 and £1,000 left to Edge's wife Elizabeth by her father Francis Hurt of Alderwasley Esq. in his will dated 13 Feb 1782 (£4,000 to be paid after Hurt's death, £1,000 after Mary his wife's death) of claims to the Manor of Heage, properties at Morley Park and Heage in parish of Duffield and at Calton, Blore, Waterfall and Northfield in co Stafford and at Alderwasley and in parish of Crich, which were charged with the payment of the legacies of the will, and reciting inter alia that Mary Hurt died in 1801, and mentioning Hurt the testator's stock of wrought and unwrought iron. - 1802
33-34 - Lease and release Thomas Webb Edge, Richard Arkwright and John Toplis, devisees in trust and executors of Francis Hurt, to Francis Hurt, reciting that the testator left premises below to his devisees in trust to sell them to his son for £4,000 and such further sum as the premises purchased by him had cost when his son reached age 21, and reciting that Francis the son is now 21 In consideration of £4,000 for the iron works etc and £4,697 13s 5d for the lands, Edge Arkwright and Toplis convey to Hurt iron furnaces, iron works and forges in Alerwasley near the River Derwent with all dams, streams, weirs, houses near occupied by Thomas Bacon, the workmen employed at the works with free use of roads etc and all lands the testator had purchased or had right to dispose of, and in consideration of 5s they sell the tools, implements and utensils belonging to the iron works. - 1802
35 - Thomas Webb Edge, Richard Arkwright and John Toplis, in consideration of £1,502 3s 7d paid them by Francis Hurt , release all right to premise mentioned below reciting in part the will of Francis Hurt, dated 13 Feb 1782 by which he charged the manor of Heage and other properties, with payment of legacies of his personal estate etc was insufficient for their payment, that he died 6 Aug 1783, that his son Francis made his will 30 Aug 1800,which recited that he had paid his father's debt and legacies of £4,000 to Edge and £3,500 to Rev John Moore in the whole £9,775 and his father's personal estate, debts owing to him, stock in trade, were £7,855, leaving a deficiency of £1,900, 1802 that he died 5 Jan 1801 and the actual deficiency was £1,502 3s 7d, which by Hurt's will of 1800 was part of his personal estate and to be levied by his father's surviving devisee in trust Philip Gell out of the real estates and paid to the son's executors, and that now Francis Hurt son of the last Francis, was owner of the properties (manor of Heage etc) - 1802
36 - Copy will Catherine Port of Ilam, Staffordshire, spinster, sole daughter and heir of John Port of Ilam Esq. decd. Refers to a lease dated 1 March 1719/20 of messuage and lands in Ballidon, Derbyshire and 3 parcels of land in Ilam, co Stafford, called Hoods Moor, Hall Moor and Ilam Moor, for 99 years from her death upon trust to pay £100 annually to persons mentioned in the lease, which is confirmed; other properties mentioned in the will are manor of Ilam, advowson of Ilam, parcel of land in Blore, Staffordshire - 1722

58 - Marriage settlement by covenant and declarationof trusts. In consideration of the marriage, Mary Hurt of Derby spinster covenants to transfer £3,700 Navy 5% Annuities into the names of Francis Hurt of Alderwasley Esq. and Sir John Borlase Warren of Stapleford Hall, co Notts. Bart and Keats covenants to invest £2,300 in purchase of Navy 5% Annuities and to purchase annuity of £400 for Mary Hurt's life both in the names of Hurt and Warren, within one month of the marriage; Hurt and Warren to hold in trust as to the £3,700. Annuities to pay dividends to Mary, as to Keat's purchases to pay dividends to Keates, during their joint lives, paying all dividends to the survivor (except for the annuity of £400 - which will cease on Mary's death and will not be payable to Keats if the survivor); then in trust for the children; if no children survive, and Mary lives the longer all dividends to be paid to her, but if Keats survives her, dividends of investment of £2,300 to be paid to him, the dividends of the £3,700 as she directs in default of direction, to her next of kin. - Jun 1820

66 - Marriage settlement Reciting that Thomas Gell of Gatehouse, Wirksworth Esq. has transferred £5063 16s 8d in £3 10 % Annuities and Anne Hurt of Derby spinster has transferred £5,700 in £3 10% Annuities, to Francis Hurt younger of Yeldersley Esq. and John Sherbrooke Gell of Standard Hill, co Notts, gent, and now in consideration of her marriage with Thomas Gell, Anne Hurt assigns to Francis Hurt and John S Gell, a bond securing £1,000 from Lord Vernon and his wife Frances Maria Warren Trusts of settlement are declared to be that Hurt and Gell hold the annuities and bond to pay the dividends etc to Anne Hurt and Thomas Gell, after their marriage, for their lives, then the capital is to be divided amongst their children, and in default of issue and of direction by Anne and Thomas, their respective annuities and bond are to be held in trust for their respective next of kin. - 1833
