2-3 - Final concord (2 parts) made between James Lowther esquire querent and William Chetwynd esquire and Elizabeth his wife defendants Concerning 2 cottages, 60 acres land, 100 acres meadow, 500 acres pasture in places as in recovery above, and half of 2 parts of the manor of Halstead in 3 parts divided, of the Rectory of Tilton, tithes etc belonging and of the advowson of the vicarage of Tilton. £460. Thomas Scawen of Carshalton, Surrey, esquire sole executor of the will of Sir William Scawen of Carshalton deceased 3. Sir Henry Maynard of Walthamstow, Essex 4. John Farewell of Carshalton gentleman and 5. John Lord Bishop of Norwich and William Farrer of the Inner Temple, London, esquire reciting mortgage dated 6 June 1722 which recited that on 21 December 1720 Sir Nicholas Carew borrowed £8,835 10s 7d from Sir William Scawen, that on 22 Feb 1720/1 Scawen was bound with Carew for the payment of £2,700, a debt of Carew to Thomas Clerk esquire, and that Scawen was bound to Wilfred Lawson for the payment of Carew's debt of £300, and which recited that £9,495 19s 10d and £3,189 11s was due to Scawen, and by which Carew mortgaged to Maynard the manor of Horn and Burstow, messuages and lands etc in the parishes of Horn and Burstow in tenures of named persons at given rents, the manor of Banstead, messuages, lands etc. Including Banstead Park (giving tenants and rents) in Banstead and all other properties of Carew in Surrey, not comprised in Carew's marriage settlement, for 1,000 years in trust for Sir William Scawen, redeemable on payment of £9,495 19s 10d and £3,000 and reciting that the £3,000 was paid, that Maynard is trustee for Thomas Scawen since Sir William's death, and that there is now due to Scawen £10,000 and witnessing that for £10,000 due to Scawen and 5s paid to Carew by Maynard, Carew released to Maynard lands above for remainder of 1,000 year term, and as an additional security for the £10,000, 1. agreed with Farrer and Farewell by Scawen's direction to suffer a recovery of ½ of 2/3 of the manor of Halstead, ½ of 2/3 of messuages, lands etc. advowsons etc. in Halstead, Tilton, 'Marfeild' or 'Marefeild South' and Whatborough alias Whatburgh, ½ of 2/3 of rectories and parsonages impropriate of same 4 places and of tithes belonging, ½ of 2/3 of advowson to vicarages of Halstead and Tilton, and of all messuages etc of Carew in 4 places named above, all in county Leicester, and declared that in consideration of £10,000 due to Scawen and 5s paid to Sir Nicholas Carew and Dame Elizabeth by Farewell, the recovery was to the use of Farewell for 1,000 years, then to use of the Bishop of Norwich and William Farrer in trust nevertheless to the separate use of Dame Elizabeth. (31 March 1724) (2) Assignment of mortgage term made between William Chetwynd of Grendon, county Warwick esquire, Dame Elizabeth Carew his wife, late wife of Sir Nicholas Carew, Thomas Scawen Sir Henry Maynard, William Farrer (as above) and James Lowther of Whitehaven, Cumberland, esquire, reciting that Sir Nicholas Carew is dead, and the reversion and equity of redemption of the manor of Horne and Burstow and the manor of Banstead in Surrey are vested in William Farrer in trust for Dame Elizabeth, and that Scawen wishes to have the £10,000 owed to him, and witnessing that for £10,000 paid to Scawen by Lowther at Dame Elizabeth's request, and for 10s each paid to William Chetwynd, Dame Elizabeth, Maynard and Farrer by Robert Lowther of Mebourn, Westmorland, esquire, Maynard at the direction of Chetwynd, Carew and Farrer, with consent of Scawen and at nomination of James Lowther, has assigned, and Chetwynd, Carew and Farrer have confirmed, to Robert Lowther, all the lands in Surrey for remainder of 1,000 year term in trust for James Lowther, subject to redemption. (24 May 1729) (1729) Stanley, she with Chetwynd's privity, released to Farrer and Stanley, ½ of 2/3 of the manor of Halstead and of messuages, lands, advowsons etc. in Halstead, Tilton, 'Marfeild alias Marefeild South' and Whatborough or Whatburgh belonging to the manor, ½ or 2/3 of rectories and parsonages impropriate of same 4 places and of tithes likewise, ½ of 2/3 of advowson to vicarages of Halstead and Tilton, county Leicester, and manor of Horne and Burstow and all lands in same parish, manor of Banstead and lands etc including Banstead Park, in parish of Banstead (giving tenants and rents), Surrey, farm in parish of Astwood, farm or parcels of land called Dytoms Pightle and the Clamp Closes in parish of North Crawley, 5 acres arable in common field in the same, tithes of Woolston, all in county Buckingham (giving tenants), and she assigned to Farrer and Stanley annuity of £850 limited to her for life by indenture of 1 February 1709/10 (when she was Elizabeth Hackett spinster and only daughter of Nicholls Hackett of North Crawley, county Buckingham esquire) and she bargained and sold to the same, jewels and plate and she demised to them messuage and lands in Hartwell, county Northampton, in possession of - Blunt and George Phillips, for a term she has, in trust for Dame Elizabeth, if she dies in Chetwynd's lifetime, as she shall direct, in default of direction in trust for heirs, executors and administrators of Dame Elizabeth.
