A/21. - 11 Nov 1817
- William Barker from Smyrna to the ex’tors of the Reverend Mr. M. Charlesworth of Halifax, (directed to John Barker esq., Ashford Hall, near Bakewell): since William is not allowed to take possession of the £2,000 left him by Mr. Charlesworth, as it is hypothecated on the Yedick or goodwill of his house, he requests ex’ors to confirm their former agent Mr. George Perkins, and send him the money to lend out at Smyrna and pay the interest to William, to maintain his family in accordance with testator’s idea. A/22. - 17 Jan 1820
- (Copy): (George Perkins), ex’tor of William Barker at Syrna to William Tomlinson, esq., London: William Tomlinson, esq., London: William Barker died on 25 July, aged 86; he enclosed copy of will, of which Tomlinson is also ex’tor: he requires instructions from Mr. Charlesworth’s trustees, to see if Mr. Barker is authorised to dispose of the legacy in favour of part only of his children: the estate is £20,000 in debt for moneys taken up, for reparation of the premises, and funeral expenses, which must be paid from future rents, and sale of furniture: William’s sons Richard, Henry and Benjamin at Smirna, and Samuel at Constantinople, think it would be in the best interest of the heirs not to sell the house - 2 Aug 1825
- William Tomlinson from London to John Barker, esq., Bakewell: death of Mr. William Barker: Mr. George Perkins and Tomlinson, ex’ors: John’s father was one of the ex’ors of the Reverent Mr. Charlesworth, and John is his representative: in his opinion the disposal of the property rests with the ex’ors of Charlesworth, and not those of W. Barker; it will be in interest of W. Barker’s family not to sell house; refers to extract from letter from Mr. Perkins, mentioning that the annual rent amounts to P13,450.00 which at current exchange of R46 per £, will be about £500, from which must be deducted repairs and ground rent thought to be about P500: is considering asking counsel’s opinion, and would like to know if John has any points to be included in case: desires to save time and expense, and be of service to late Mr. Barker’s family. (On same sheet): Copy of J(ohn) B(arker)’s answer to Mr. Tomlinson: agrees that William Barker had no right to dispose of hypothecation; thinks it best to have counsel’s opinion, whether the money is to be divided equally between William’s children or at discretion of Mr. Charlesworth’s ex’ors: if it is at their discretion, he will be glad of assistance from Messrs. Tomlinson and Perkins as he knows little of the circumstances of his uncle’s family: agrees that house should not be sold at present. A/24 - 29 Sep 1825
- 1826 February 1: (Copy): Richard Barker; H. R. Barker; Benjamin Barker; and Samuel Barker (signature added at Constantinople on 10 February) to (Mr. Tomlinson): refers to former letter in which they desired that their father’s will should be carried out, but that the house should not be sold yet: now, since some of the family do not agree that it is best to delay sale of the house, they, wishing to avoid law discussions, beg leave to annul their determination to give up their share of the £2,000 under the Reverend Mr. Charlesworth’s will; they are no longer of the opinion that it is best to delay sale as any apparent advantage would be lost by the determination of the Turkish currency: they request him to inform Mr. Charlesworth’s ex’or that they desire a speedy settlement of the affair. (on same sheet): 1826 March 21: (Copy): (Mr Tomlinson to counsel): in case submitted, the principal question is whether the ex’ors of Charlesworth or of Barker have right to dispose of £2,000 advanced by Charlesworth’s ex’ors on security of Barker’s house at Smyrna: houses held by foreigners in Turkey are held by Yedick, similar to copyhold in England, subject to a small ground rent to Turkish proprietor; Barker thought he was free to dispose of the legacy or the house on which it was secured, and the hypothecations mentioned in his will, to be paid off, are some small sums borrowed on the rents of the house; the house will produce only the £2,000 or less: if Barker’s ex’ors can dispose, there is no difficulty; if the control rests with Charlesworth’s ex’ors, are they to divide it according to Barker’s will, or as per copy annexed, from Mr. Barker’s four sons: he supposes it must go into Chancery: hopes to send counsel’s opinion in a week or 10 days: he believes the list he sent of Mr. Barker’s family is correct and that George died in America.
