He was the nephew of Sir John Franklin. He studied at Rugby School and St John's College, Cambridge; he became a lawyer, being called to the bar in 1849. He went on to marry Fanny Lydia Murdoch in 1848 and they had at least three children (Edith, Kate and Willingham).
