DescriptionMarriage settlement (Damaged) between Arnold Kirke the elder of Martynside in the parish of Chappell in le Frith [Chapel-en-le-Frith], yeoman, Arnold Kirke the younger, his son and heir apparent, Henry Kirke of Spott Grange, Staffordshire and George Kirke of Watersyde, Chappell in le Frith yeoman, brothers of Arnold Kirke the elder, and Ralphe Cantrell of Westowne, Derbyshire, yeoman. In consideration of the marriage, already solemnised,between Arnold Kirke the younder and Anne Cantrell, daughter of Ralphe Cantrell, Arnold Kirke the elder, his son, and brothers, will before Michaelmas, by fine, common recovery or other assurance in law, convey to William Sherte the younger of Disley, Cheshire, gent., and to Henry Cantrell of Little Hucklowe in the parish of Hope, yeoman - capital messuage called Martynside, with all lands, tenements, etc. belonging, in parish of Chappell in le Frith and township of Bowdon, now or late in holding of Arnold Kirke the elder or his assigns; messuage called the Jumble with all lands, tenements, etc. in the parish of Chappell, now or late in the occupation of Arnold Kirke or his assigns, lately purchased of Richard Stephenson: also a fourth part of a herbage or farm or pasture called Herralds or Halsteeds in the parish of Chappell, also in the occupation of Arnold Kirke the elder or his assigns, lately purchased of Peter Bradshawe, gent. and Thomas Bradshawe of Bradshawe, both deceased. The said William Sherte and Henry Cantrell shall be seised in the above premises to the following uses and intents. One moiety of the premises to the use of Arnold Kirke, the father, for life, and on his decease to the use of Arnold Kirke the son and his lawful male heirs on the body of said Anne. In default of issue them successively to the use of Thomas Kirke, second son, Henry Kirke, third son and George Kirke fourth son, and their lawful make heirs. In default of such male issue, them to e seised of a moiety of the messuage called the Jumble and a moiety of the herbage called Halsteede, to the use of the right heirs of Arnold Kirke, the father, for ever, and to hold a moiety of a messuage called Martynside to the use of Henry Kirke second brother of Arnold Kirke and the father and his lawful male heirs; in default of issue tot heuse of George Kirke, third brother of Arnold Kirke the elder and his lawful male heirs, and in default of such issue to the use of the right heirs of Arnold Kirke the father for ever.

The other moiety of the premises to be held to the use of Arnold Kirke, the son, and Anne his wife for the lives, then to their lawful mail heirs; in default to lawful male heirs of Arnold Kirke, the son, in default of issue to use successively ot Thomas, Henry and George Kirke and their lawful male heirs as before. In default of such male issue to hold the other moiety of messuage called Jumble and herbage called Halsteede to the use of the right heirs of Arnold Kirke the father for ever and the other moiety of messuage called Martynside to use successively of Henry and George Kirke brothers of Arnold Kirke the elder and their lawful male heirs as before, and in default of issue to the use of right heirs of Arnold Kirke for ever. If at the time of the decease of Arnold Kirke, the son, there is no male issue but one or more daughters lawfully begotten, then they shall take out of the rents and profits issuing from the above premises £250 each, at the rate of £20 per annum.
