Description Francis Hurt conveys to Thomas Bainbridge the younger of Woodseat, co Staff Esq. and Bradshaw Galliard of Edmonton,co Middx Esq., messuage in liberty of Heage ("Highedge") lately built by Francis Hurt, closes etc in possession Thomas Poyser at clear rent £95; closes etc in Heage in possession John and Thomas Hawkins at clear rent £23, awarded to Hurt in enclosure award for that part of Belper ward belonging to Heage; closes at or near Calton called the piece in the Town Head Lands, Broad Butts, New Close, Three Nookt Piece, Stanthorne Closes, Stone Pitts, Two Carthouses, Lane End Croft, the Poppidge, Cliff near piece, Milkhill Close, the Caping, the Caping Close, the Two Capings Heads, the Ferney Flatts, pieces containing 10a in Overfield near Calton, all in possession John Smith, clear rent £80, to use of Francis until the marriage, then to use of John Toplis of Wirksworth mercer and Thomas Ince of Wirksworth gent for term of 1,000 years, in trust to pay Philip Gell the younger annuity of £160, permitting Hurt to have surplus of trust lands' profits to mortgage or sell trust lands to raise up to £4,000 for younger children's portions or for eldest son if no other children or to raise up to £2000 for purposes as directed by Philip Gell, if there are no children; the term expires when trusts are executed Francis covenants with Philip the younger that if Cassandra or any child of theirs living at deaths of Francis and wife Mary, his executors will pay Philip £1,000 as addition to Cassandra's fortune
