Description
reciting that by indenture dated 14 March 1888 made between Holden and Alfred Smith and Frederick Swindell plaster mines lying under a portion of the estate agreed to be sold in the agreement above at or near Chellaston and comprising 93 acres 3r 16p were leased to Smith and Swindell for 14 years from 25 March 1888, that on 23 December 1893 the lease was altered, but not the term, that on 23 June 1894 Holden demised to Zachary Smith and Sarah Ann Smith the plaster mines under other portions of the estate and containing 114 acres 2r 14p for 10 years from 25 March 1894, and agreeing that after the expiration of the terms during the joint lives of Holden and Winterbottom, the latter should receive any rent or royalty from letting any plaster mines in the areas comprised in recited leases, paying whilst both live one tenth of the net profit to Holden, the agreement to be void if either dies or any of the land concerned is sold
