DescriptionIn consideration of the marriage of Thomas Hickinbotham the younger and of Elizabeth Hickinbotham and reciting that Elizabeth is possessed of £200 secured to her by bond and her father has promised £400 to be paid after the marriage and it has been agreed that Thomas the younger shall take the £400 and that the £200 shall become his property at the marriage, and witnessing that for 10s. paid by Harrison to 1. and 2., the latter two conveyed to Harrison, a messuage, tenement or farmhouse in Aston, Moor Dyke Close containing 6 acres 13p. in a field before the enclosure of the common fields called Alderslade Field, 3 closes called Parsons Flatt, Chalk Pitt and Top Hill, together 22 acres 2r 36p in Alderslade Field, Allser Meadow, 9 acres 2r 38p. lying at the time of enclosure in the Meadow, all of which were at the enclosure allotted in 3 pieces to Thomas Hickinbotham deceased father of 1. in lieu of lands reputed one yardland containing 30 acres and of 5 cow gates and 50 sheep pastures, all of which were included in marriage settlement of 8, 9 August 1755 of Thomas Hickinbotham the elder and his wife Mary, and also of several pieces reputed to be half a yard land and several odd pieces of land and several commons or common of pasture to the half yard land and other parcels belonging, purchased by Thomas deceased from his brother William Hickinbotham the elder in 1743 and not included in the settlement, and they conveyed to Harrison 2 closes called the Moors together 7½ acres in a place heretofore called Aston Moor and in an enclosure of the moor before the other enclosure allotted to Thomas Hickinbotham deceased, as his proportion thereof for his common rights in respect of the messuage and open field lands, all of which premises are in the tenure of Thomas Hickinbotham the elder, in trust as to the messuage, Moor Dyke, Parsons Flatt, Chalk Pitt and Top Hill, which 4 closes it is agreed shall be adequate compensation for the yardland and other lands, commons and open property comprised in the said settlement, to the use of Thomas the elder and Thomas the younger according to their respective estates under the settlement until the marriage of Thomas the younger and Elizabeth, then successively to Thomas the elder for life, Thomas the younger for life, Elizabeth his intended wife for life for her jointure, William Harrison for remainder of above lives and during their lives to preserve contingent uses, Jacob and William Hickinbotham the younger for 1,000 years to begin at death of survivor of above lives to use of children as Thomas Hickinbotham the younger and Elizabeth shall direct, in default of direction to use of Thomas and Elizabeth's heirs, and finally the right heirs of Thomas the younger for ever, and as to Allser Meadow and the Moors, deemed to be a proper compensation for the half yard land and other lands etc. not comprised in the 1755 settlement, to the use of Thomas Hickinbotham the elder for ever, and as to term of 1,000 years limited to Jacob Hickinbotham and William Hickinbotham the younger, in case there shall be no issue of Thomas and Elizabeth's marriage or it shall die in the life of Elizabeth, upon trust to raise £300 and interest to pay as Elizabeth directs, in default of direction to pay the same to Elizabeth's next of kin, exclusive of her intended husband, the term to cease when trusts are carried out. With covenant to levy a fine to enure to the uses of this settlement
