Description
Reciting deed of 31 March 1724 (see D779B/T 592) and that in lease and release of 31 March and 1 April in consideration that Elizabeth had charged her paternal estate in Leicestershire with payment of a mortgage due to Scawen, Carew had conveyed his Surrey property in trust to convey them as she should direct, and reciting that Carew is dead and Dame Elizabeth remarried to Chetwynd, and that Scawen wants his £10,000, and witnessing that for £10,000 paid to Scawen at the request of Chetwynd and Dame Elizabeth, by Lowther, and for 10s. paid by Lowther to Farrer, by Dame Elizabeth's appointment, Farrer released and Chetwynd and Dame Elizabeth confirmed, all the Surrey and Leicestershire properties as in marriage settlement of 1728 to use of James Lowther subject to redemption.
