DescriptionIncluding various recitals, amongst them the deeds (above) dated 23, 24 May 1729 and 17,18 May 1728, and that William Chetwynd at the instance of Walter Chetwynd esquire his brother now deceased and as surety for Walter was bound to several persons for the payment of various sums and interest, in all £3,670 which with interest is unpaid (details of persons and sums involved) and Rider and Jervis joined as sureties in the said bonds, and William and Walter Chetwynd were bound to Rider and Jervis in several penal sums in several bonds for payment of the sums above, and William Chetwynd was further bound with Walter in several bonds for payment of further sums and interest (giving details) totalling £5,350 which with some arrears of interest are unpaid and William was bound with his brother, John Wightwick esquire and William Russell of Birmingham ironmaster for payment of £1,000 and interest which with an arrear of interest is unpaid and witnessing that for 5s paid to Farrer, Stanley and Chetwynd by Rider, Spateman and Jervis, the Leicestershire and Surrey properties as in marriage settlement dated 17, 18 May 1728, were released by Farrer and Stanley, at the instance of Chetwynd and Dame Elizabeth, and by Chetwynd and Dame Elizabeth, to Rider, Spateman and Jervis in trust to pay out of the rents or by sale enough to discharge the £10,000 and interest due to Lowther, and then to pay sums and interest on them, mentioned above, then to pay the surplus of rents and profits to Farrer and Stanley in trust for Dame Elizabeth, provided that if Lowther is paid and Rider and Jervis are indemnified against the bonds they entered into (see above), then Rider, Spateman and Jervis will reconvey the premises to Farrer and Stanley in trust for Dame Elizabeth, provided that until default is made, Lowther or Chetwynd or Dame Elizabeth may receive the rents, and in default of payment of bonds and indemnification of Rider and Jervis, Lowther declares that after payment of the £10,000 due to him, he will remain seised of the premises and the terms of 1,000 years in trust for Rider, Spateman and Jervis.
