Description | Reciting lease and release dated 20, 21 May 1725, that Bryan has very great occasion for £200 in order to discharge debts and Mary has consented that the money be raised on her jointure estate, in consideration of which Bryan has agreed that the properties shall be settled in trust to be sold to discharge the debt, the residue of the purchase money to be to the sole use of Mary, that Thomas and Mary have borrowed £200 from Revell secured by mortgage dated 5 June (see above) and witnessing that Bryan covenants with 3. to levy a fine to Revell of the premises in the mortgage, to the use of Revell for 500 years subject to redemption for £200 and interest, then to the use of 3. in trust to sell the premises using the money to repay Revell, the residue to buy other premises and settle them so that Mary may enjoy the profits during the lives of Thomas and herself; if she outlives Thomas, they are to be conveyed to her use for ever; if Thomas outlives Mary, they are to be conveyed as directed in her will or, in default, to the use of Mary's children and (if they are dead) to their children equally, in default of issue that Thomas may have annuity of £20. |
