DescriptionReciting that whereas there have been disputes between the Lord Henry de Lacy, Earl of Lincoln in certain places and pieces of land, meadow and waste of his in Castle Donington on one side of the Water of Trent [River Trent] within the county of Leicester and the lord Thomas Abbot and the convent of the Abbey of Saint Werburgh of Chester concerning certain other places and pieces of land, meadow and waste of the Abbot and convent in the manor of Weston and the hamlets of Shardlow and Wilne on the other side of the water of Trent in the county of Derby, now on 17th February 1309/10 they have each agreed over the disputes as written below, that is, the Earl has conceded for himself and his heirs that the Abbot and convent and their successors may henceforth receive and have one third part of the profit coming from the barge and boat of the Earl making the passage over the Water of Trent to the county of Derby and similarly making the passage from the county of Derby to the county of Leicester by the way which is called le Bargeford and similarly the Earl has conceded that the Abbot and convent shall henceforth have a suitable road for carriage of grass and hay from a certain piece of meadow of the Abbey and convent which is called le Steure through the meadow and pasture of the Earl which is called Langholm with horses, carts and wagons to a certain way called Langholmford over the water of Trente to the manors and hamlets of the Abbot and convent in the county of Derby and if that way should in future be so flooded that the grass and hay cannot be carried by it, the Earl has conceded that the Abbot should have a suitable carriage way from le Steure to another way near and suitable adjoining the Earl's meadow over the water of Trent if such way may be found, for which road the Abbot shall pay the Earl 12d annually at Castle Donington at the feast of the nativity of St John the Baptist [24 June] for ever, and the Earl has conceded to the Abbot that he shall peaceably and without impediment be able to save and defend his lands, meadows and pasture of his manor of Weston and hamlets of Shardelow, Wilne and Aston from penetration by the watercourse of Trent on the day of this writing in the aforesaid manor and hamlets, saving however to the Earl his lordship in the waters of Trent and in the fisheries everywhere in the waters just as his ancestors have been accustomed and similarly the Earl has conceded that men, animals and other goods crossing the water of Trent by boats and barges at le Bargeford and landing below le Bargeford in Castle Donington should have a suitable road to the high road which leads to Leicester and they shall be protected harmless in so far as is in him. And for the above concessions, the Abbot and convent for themselves and their successors have conceded that they shall henceforth find the third part of the materials and expenses in new building and repairing the boats and barges aforesaid whenever necessary and that the boats and barges may land upon the land and fee of the Abbot and their tenants in Wilne above the water of Trent at le Bargeford and below le Bargeford without impediment and likewise they shall find a suitable way for all crossing with animals and other goods over the water of Trent and landing within the land and fee of the Abbot in Wilne below le Bargeford, to the high road which leads from le Bargeford to Derby within the lands and fee of the Abbot and convent and their tenants in Wilne, and they will keep harmless men, animals and goods crossing the water of Trent by boat and barge and landing in Wilne as far as in them.
