Description
Reciting a judgement in Chancery which recited that in Trinity Term 1657 Robert Houlden gentleman complainant exhibited a bill of complaint against Nicholas Willimott esquire declaring that there were controversies between them concerning lands in Weston and in particular the Hollowe Close, that there was a cause in ejeccione firme between Edward Sitdowne as lessee to complainant (then plaintiff) and ?Can...or defendant, tenant to the now defendant, which was ready to be tried in Easter Term 1655 in the Upper Bench, and the complainant and defendant there agreed to refer their differences to Mr Sergeant Newdegate, who on 29 August 1655 awarded an equal division of Newe Close alias the Hollowe (further details) and William Leaper of Osmaston gentleman and John Houlden of Wilne gentleman were nominated to make the division, the division was made and each party entered his part of the premises, assurances were made by the complainant to defendant and vice versa of their halves of the property, but the defendant delayed to execute his and to levy a fine as agreed, by reason whereof - (missing) of the defendant were encouraged to disturb the complainant in his moiety, so the complainant prayed relief from the court, and after the defendant's reply, examination of witnesses etc., on 1 February 1658/9 the court decreed that the award was confirmed and that each party was to execute a conveyance to the other. Now the chancery award is ratified, each party is to convey half the premises to the other, and Willimott is to perform the decree.
