Descriptionby which he bequeathed all his real estate in the City of York or within 5 miles of York to the use of Francis Hurt of Alderwasley esquire and Richard Murphy of the Borough of Derby esquire in trust to sell, subjected all property in Hawton, Newark upon Trent and Farndon, county Nottingham, to payment of debts, legacies and annuities and gave the same, subject to above payments, to Hurt and Murphy for 99 years to receive the rents, and as to rents of York property until sold and the sale money, in trust to pay the debts, annuities and legacies, then after payment of same and deaths of annuitants, bequeathed county Nottingham properties above, manor of Darley, mansion house in which Holden lives, all other property in Darley, property in county York and in Normanton, county Nottingham to cousin Robert Holden for life, then to Sir Robert Mead Wilmot of Chaddesden bart and Edward Hartopp the younger of Little Dalby, county Leicester, esquire for the life of Robert Holden to support the contingent uses but permitting Holden to receive the rents, then to use of Hurt and Murphy for 500 years upon trust, on the expiration of the 500 year term, as to property in Darley, county York and Normanton, to use of Mary Anne wife of cousin Robert Holden, for life while continuing unmarried after death of husband, then on determination of trusts, all the properties in 500 year term, successively to sons of Robert Holden the cousin and their heirs male, daughters of cousin Robert to be divided equally between them, Reverend Charles Holden clerk (youngest son of late cousin Mary Shuttleworth) and his heirs general, James Hurt, second son of late Francis Hurt esquire deceased by Elizabeth his wife, youngest daughter of Mary Shuttleworth, and heirs male, Henry Hurt, third son of Francis deceased by Elizabeth his wife, and heirs male, and testator's right heirs for ever, and as to the 500 year term above, testator declared it was upon trust to raise portions for the younger children of cousin Robert (details given) and to maintain them from decease of their father until their portions shall be paid, the residue of the rents going to whomever the next reversion belongs;
bequeathed leasehold estates in county or city of York to cousin Robert Holden for life, then to same persons to same uses as freehold and copyhold estates in county York as before limited;
empowered cousin Robert Holden to appoint up to £300, chargeable on properties in Darley, county York and Normanton, to a future wife for her jointure;
gave annuities of £200 to friend Richard Murphy, of £50 each to butler Robert Harpham, gardener John Wilkinson, footman Mark Whitworth, of £30 each to late coachman Thomas Smedley, late groom John Baker and housekeeper Susanna Peat, out of Hawton, Newark and Farndon lands;
gave £6,000 to Robert Shuttleworth the younger, second son of Robert Shuttleworth of Barton Lodge, county Lancester, esquire and grandson of Mary Shuttleworth, £100 to Robert Shuttleworth the elder, £100 each to Charles Holden, Mrs Elizabeth Hurt, widow of Francis Hurt esquire, William Lascelles of the Inner Temple esquire Richard Murphy, and Reverend Benjamin Barnard clerk prebendary of Peterborough, £50 to friend John Barnard esquire, £20 each to friend Reverend Joseph Collier, Mrs Ann Lowe of Derby and Reverend Ellis Henry of Derby, to be paid out of sale of York property (as above) and out of real estate in county York;
gave year's wages to all servants, horses, hay, corn, liquor, wine and linen in testator's house to cousin Robert;
gave the use only, not the property, of silver, plate, books, pictures, household goods and furniture to cousin, Robert for life, an inventory thereof first to be taken by executors, then the use of same to whomever is entitled to house and estate at Darley as heirlooms and to accompany the limitations of house and estate at Darley;
gave wearing apparel to footman Mark Whitworth and ready money and securities to cousin Robert Holden, subject to payment of funeral expenses. Executors to be Robert Holden and Richard Murphy.
Also copy of codicils:
1) 27 June 1806 by which Holden provided that if William Drury Lowe father of Mary Ann wife of testator's cousin Robert Holden, does not have a son, then properties in Hawton, Newark and Farndon, Darley, county York and Normanton, are not to go to cousin Robert's eldest son, but successively to his other sons and their male heirs, and then to the first son and heirs male, then as in will, and that the younger son inheriting shall be excluded from portions and maintenance, as well as the eldest son, and he gave to each of the 5 children of Robert Holden late of Jamaica esquire decd. £100 out of money from sale of city of York estate and out of rents of the same meanwhile, and out of Nottinghamshire property (not Normanton)
2) 1 May 1807, by which further annuity of £200 was bequeathed to Richard Murphy, making £400 in all
3) 17 Sep. 1807, by which annuity of £10 was bequeathed to Sarah widow of Francis Cooke servant to Robert Holden's late brother Atkinson Holden esquire
