This case related to a prosecution brought under the Mines Regulation Act 1872. The general agent of Langley Mill Colliery, a pit belonging to the Butterley Company, appealed unsuccessfully against his conviction for failing to fence a fly-wheel and dangerous portions of a chopping machine. The consequence was that a workman chopping hay and straw for horses in the mines was injured. The appeal was dismissed and the Judge gave as his opinion that proper management of the mine required enforcement of compliance with regulations, not merely alerting workmen to their existence.
