Title | Settlement between i) Ann Clayton, wife of Robert Clayton, gentleman, of Birkin (Yorks) ii) Jeremy Hoet, gentleman, of London iii) Thomas Wright, gentleman, of Sheffield, iv) Vannam Clayton, gentleman, of Clowne, son of Robert Clayton, reciting will of Elizabeth Taylor, by which she devised to Robert Barker of Grays Inn the manor and advowson of Birkin (Yorks), with all lands belonging, with Birkin (Yorks) Holme and Birkin (Yorks) Hall, with all manors and lands mentioned in settlement of 17/18 May 1676 [D547M/T210], and in decrees of Chancery, and annual sum of £320 with arrears, and £2000 with interest charged on lands for Dorothy, daughter of Everingham Cressey and wife of Archibald earl of Roseberry, in trust to discharge a debt of £1200 on mortgage to Robert Thornhill, with other debts, remainder to use of Ann Clayton; now Ann, in consideration of £200 paid by Vannam, and in consideration that Vannam will advance £1200 to Robert Thornhill at rate of 5% instead of 6% per annum, appoints Robert Barker to sell all lands to Jeremy, in trust to discharge debt of £1200 and interest to Robert Thornhill, with other debts, remainder in trust to apply Birkin (Yorks) Holm and all Elizabeth Taylor's lands in Selby, Brayton and Hirst Courtney (all county Yorks.), to use of heirs of Ann Clayton during her life, then, except Birkin (Yorks) Holm and lands at Selby, Brayton and Hirst Courtney, in trust during life of Robert Clayton for whoever Thomas Wright shall appoint, remainder to use of Vannam for ever. |
