Description | Special case made upon application by the Duke of Devonshire to question a conviction made against him in 1896, on the grounds that the conviction was erroneous in point of law. The case concerned a disused mine, Carther Low Mine, Hartington, and the requirement under the Metalliferous Mines Regulation Act 1872 that the opening to the mine be securely fenced off in accordance with the request of the Inspector of Mines. The Duke of Devonshire was the owner of the land with an interest in the Mine.
