James Longsdon - part of Cock close - line to be drawn from SE corner of Mr Hulley's house directly across to Barn lands, also field called "Field" 1 acre, 1 rod and 24 perches both at £90 per acre. J Longsdon to pay all expenses, to make fence in Cock, and pay Smithers on Lady Day when he will let him into possession. Title can only be completed on William's return - but in preparation must be clause effectually preventing any person from building any dwellings on pain of forfeiture of land to writer's heir at law.
Peter Longsdon - 16 yards of land to start 1 or 2 yards west of Pump at Cockgate and 2 or 2½ yards south from well of Cock close - run 16 yards south and then, east to corner of fence at bottom of Cock and P. Longsdon's garden. P. Longsdon to pay 1 s per yard and tied from ever using any building that may be erected as dwelling.
For own land - throw Cowhay - Swifts Close adjoining Lower Meadow, Flash, Jacksons yard, Pidcocks croft and Cock into 1 pasture and to stock it as Smithers thinks best. Keep whatever is necessary to mow and let rest for 1 year. Mrs Longsdon will stay in house as long as she likes but when she leaves it please do anything necessary to make it dry and habitable. Enquire of Wager whether Trustees have given tenants of cottages and land due notice of sale to William. Cottages occupied by William Hulley and Margaret Stone. Writer shall want in his own hands and the sooner they can get out the better. As to William Hulley, writer should prefer giving him or whoever tenant is £5-£10 to induce him to move from village. M Stone must be accommodated some how - might occupy part of Gregory's house by repairing or adding a little to it. If not, do the best he can with her. In letting land include all conditions Smithers thinks necessary. Shall want to make some addition to the garden from the bottom of the pasture.
Of £1000 retain as much as may be needed for farming concerns and pay Mr Charge until writer's return circa £350, he expects. Remit balance to L&H of Liverpool as Smithers conveniently can - hope it suits him to let them have £650 by 31 December. Also remit to them what James Longsdon gave him and any balance remaining between them on their present open account leaving amount at his debit at end of year £......... as agreed.
Pay Johnson and Taylor balance of writer's Mother's account - say about £30 and charge to writer. Writer has asked White Watson to send his account for creating two tombstones - said about £7 or £8 for each. If money left applicable for these purposes is not enough, Smithers must retain what is. £30 to Uncle John for annuity on 29 of this month. Touching Duke's farm act entirely at discretion. Do not trouble with alterations or repairs at Little Longstone until writer's return.
Mr Charge will see that good title obtained. Will ask him to receive legal possession and place under Smithers' control. Shall place in his hands bond now held by Trustees of Mrs Smithers for £1000 as well as sister Bessy's bond for £1000, writer's own bonds for £1000 and £1500 in lieu of 2 first which have been amended to Trustees of settlement bearing 4%. Shall arrange with L&H to supply Smithers with money necessary to complete purchase - say £4000.
At time of settlement pay £60 to W Wager in part payment of Jonas Close - requires no receipt.
Hand him with this a letter of credit on L&H for about £4000 and copy letter to Mr Charge containing Mr Cutts' receipt for above from Bonds amounting to £4,500. Please get Mr Charge to read and acknowledge.
Left note of hand for Hannah Morton £35 at 3½%, he to receive money from her.
To pull down all or part of old cottages if allowed and do what draining is necessary to knock away fences to make the pasture in front and to make small plantation on top of Cowhay. Peter Longsdon will assist all he can as manager.
Papers left with Mr Smithers. Copies of wills of Father and Brother and power of attorney to sign legacy receipts for William.
