"as you mentioned when I was at Derby that a convict, sent to work upon the Thames, has been refused by Duncan Campbell because he was sent by the county sessions; on my return home I looked into the act of parliament and found there could be no doubt about the right of passing such sentence. If, therefore, the man convicted last week at the town sessions should likewise be rejected, I shall certainly recommend it to the corporation to preserve the dignity of their court by moving for an information against Campbell in the King's Bench. It will be right however, for us to be perfectly regular and formal on our part ..."
