Description
The will of Sir William FitzHerbert (D239 M/F 140) was the occasion of a protracted suit in Chancery. As the will was not clear on some points, the executor, Richard Bateman, was advised by counsel to proceed in his trusteeship only with the direction of the court of Chancery. This he did. A dispute then arose between Dame Sarah FitzHerbert and Bateman, apparently over the annuity left to Sarah. The dispute and the execution of the will was complicated by the deaths of Sarah and her eldest son, Anthony. These deaths left all the younger children as minors. The court appointed receivers for the Derbyshire property, Francis and then John Beresford; Henry Gally [Knight] acted as guardian of the FitzHerbert children following Sarah's death; he was their uncle by his marriage to Selina, sister of Sir William FitzHerbert
