Further information: In 1949 Lavender was awarded a 2 per cent for life disablement assessment. Medical Board of April 1950 said 'This man's disability is due to degenerative conditions of bones and and blood-vessels due to his age'. Handwritten beneath this 'Slur. 50 years in pit. tens of years Packing.' Local Appeal for Special Hardship Allowance in June 1950 was favourable to Lavender but not unanimous and only 15/-d per week for a month, so the suggestion put to Mr Dawes (New Ormonde branch NUM secretary) was that a 'strong supporting statement' was required from the claimant's panel doctor. This was obtained dated 1 July 1950 and stated 'the degree of arterio-sclerosis present is not very marked and I think it is unlikely to cause a sudden change from fitness to ill-health. The accident sustained in 1949 has undoubtedly contributed to the onset of symptoms.' Application was made for leave to appeal to the Commissioner. The Insurance officer put the case forward but stated she did not support it. The NUM put forward that the Insurance officer's report ignored the point that 'Lavender since the accident has not been able to return to his own work or work of an equivalent standard'. The Commissioner's response was that the Medical Board's decision of 20 September 1949 should be appealed against, even though the normal time period for such a claim had elapsed it was suggested that the first step was to apply to the Chairman of the Medical Board for an extension of time. Leave to appeal was granted. An appeal date set for February 1951 was adjourned as claimant was attending hospital for an X-ray. Handwritten note on Decision sheet says 'also Local Appeal 1956'. Tribunal decision note includes: 'This man [...] has had blackouts frequently on suddenly changing his posture. There can be little doubt that he sustained an injury to his cerebral circulation'. Handwritten pencil note in latest paperwork says ' 6 brothers all more than 50 years in pit'.
