Further information: Investigations showed a squamous cell carcinoma of the lip at the site of the injury, which was treated with radiotherapy, 'The injury to the lip could have been responsible for the development of the carcinoma'. This information was marked 'Not included in claimants papers'. The Tribunal disagreed with this finding but repayment of benefit 'overpayment' of £50. 16. 0d. was not required 'As I am satisfied that the benefit was obtained in good faith'. No mention of smoking in relation to the cancer.
