Further information: A copy of a medical report dated 10 September 1950 states 'This man suffered an injury to the back on January 5th, 1950. The injuries were of the nature of severe bruising which though not in themselves serious were extremely painful and gave rise to considerable anxiety and distress on his part.' It happened when a piece of dirt fell from the roof onto his back. He was off work for 22 weeks. The injury was assessed at 5 per cent on 7 June 1950 and the claimant appealled. A tribunal hearing on 16 August 1950 upheld the decision of 14 June 1950 on the grounds that 'We cannot in any way attribute this man's abdominal condition and vomitting [sic] of blood to the accident of 5th January last.' A letter dated 29 September 1950 headed 'Re: The question of Appeal for Revision' states 'Your appeal will be made under Section 40.' The Tribunal decision dated 27 February 1951 states 'This review could only be entertained if the medical board is satisfied by fresh evidence that the decision was given in consequence of the non-disclosure or misrepresentation of a material fact. The review board were not so satisfied.'
