Further information: This is a Local Appeal Tribunal case. According to the Summary of Claim for the hearing on 20 September 1951, the claimant had an accident on 18 July 1950 'whilst following his regular occupation of screen hand and surface labourer.' There was a question over the amount of overtime and wages paid and the Insurance Officer's submission states 'The appellant is quite clearly following work of an equivalent standard which is suitable i n his case, and it is submitted that he does not qualify for an increase on account of special hardship.' It is also noted that 'The Commissioner has ruled that earnings for overtime work should not be included in the standard of remuneration of an occupation unless the earnings of overtime was such a regular and constant feature of the occupation that it could be considered unusual for overtime not to be earned.' The Local Appeal Tribunal found against the claimant on 20 September 1951
