Title | Medical Appeal Tribunal case file for Edward Gaughan, aged 43, [occupation not stated] at Glapwell, relating to an Industrial Accident |
Date | 1951 |
Description | Date of birth: 17/05/1907 Marital status: Married Address: 1 Hucklow Avenue, Boythorpe Type of injury: Amputation - lower leg Description of accident: Whilst lashing loads onto a rope, foot caught in loop in chain Further information: The claimant had an accident on 15 March 1950 which resulted in amputation of the lower leg. It was assessed as 40 per cent final by the Medical Board on 13 January 1951. The grounds for appeal dated 14 February 1951 were 'that the stump left is within the 5 inch group.' According to the Tribunal referral 'The Medical Board on 15 August 1950 reported:- Stump 5½" as measured from the anterior edge of the upper articular surface of the tibia with knees flexed, and made a provisional assessment of 40 per cent for six months.' The appeal on 22 March 1951 was accepted on the grounds that 'The stump is 4¾" from the upper edge of the tibia to the line of the amputation, and therefore comes within item 26 of First Schedule to the Benefit Regulations under which there is an assessment of 50 per cent. The stump is tender. This should improve when the stump is hardened in the artificial limb.' |
