The appeal was on the grounds of sustantial and unforeseen aggravation. In the Tribunal findings: 'there was no substantial and unforeseen aggravation. The repair of the hernia is very satisfactory. The assessment of 20 per cent final [...] is set aside'. Cutts had 34 episodes of incapacity to work in the previous 2 years.
