Further information: Hardy has recurring dermatitis, with the latest attack in July 1948. He resumed surface work in November 1948 and it was noted that his 'condition is improving.' A medical report dated 30 May 1950 noted that Hardy was 6 foot and weighed 9 stone 6lbs. Minister's Observations include: ' there is nothing to suggest that the inability to work in heat and dusty places was a result of the relevant disease - rather it was the cause of its appearance'. Claimant in appeal states:' the Medical Board cut (the disability award) down to 1 per cent for life which is poor returns for a man who has worked all his life in the coal mines.' On appeal the extent of disablement was decided at 20 per cent for 5 months, reducing to 10 per cent from 25 November 1950 to 25 May 1951 after a Medical Board examination on 13 October 1950. There is a letter from Hardy to Joseph Kitts, the Area Compensation Agent, dated 31 October 1950 appealing against the reduction. The reply from Kitts states he is unable to appeal as the decision is provisional, and explains the payment system to him.
