The claimant had an accident in 1952 while he was a drawer-off and a Sylvester hook broke, at Pleasley colliery. According to the Summary of facts on the Appeal referral, special hardship was paid up until 17 June 1958, but 'a further award was not made as following the suspension of the voluntary Saturday shift, it was considered that he was not following an occupation of an equivalent standard.' The tribunal found against the claimant and there is an undated note which states the case 'was not accepted by the Insurance Officer owing to the present earnings which included overtime being on a par with the amount of earnings he would have received had he been able to do drawing off.' In the tribunal report dated 22 July 1958 the Chairman's evidence states 'Likely to have permanent loss of faculty.[...] Now no conveyor belt attendants in Claimant's district of the colliery. There are still conveyor belt attendants in other districts of the pit. These positions are held by disabled men mainly. Cannot push one of these out to put claimant in.' There is a handwritten note in pencil on the decision form which says 'also Med appeal Jan 1954.' |
