Title
Local Appeal Tribunal case file for Thomas Allen, aged 38, Stripper at Coppice No. 3
Date
1956
Description
Date of birth:
Marital status: Not given
Address: 19 Sheldon Drive, Loscoe
Type of benefit claimed: Special Hardship Allowance
Type of injury: Injury - wrist
Further information: Colliery was Coppice 3. Beat wrist diagnosed in 1951, leading to a 5 per cent assessment for life in 1952. Claimant had been in receipt of Special Hardship Allowance for various periods. Resumed occupation as an 'odd-worker, a conveyor attendant and supplies transporter'. Hearing adjourned for medical evidence 25 January 1956, this included GP letter stating that a further diagnosis of Kienbock's disease had been made and stated 'I am definitely of the opinion that he is not capable of following his regular occupation'. 'Work as a ripper does of course involve consistent use of the wrist joint.' (Also from Doctor's Report.) Case turned down at the Local Appeal Tribunal, with Findings stating: 'Kienbock's disease is the result of process and not of industrial accident' and that the disease is not a consequence of Prescribed disease no 34 and is not connected with it, also stating that the Medical Boards diagnosed 'tenosynovitis Rt [right] wrist'. The claim went to the Commissioner but was unsuccessful. The Commissioner's decided that it was the disease, not the disability attributable to Beat wrist, which precluded the claimant from following his regular occupation.
