Findings of Tribunal: 'Road belonged to NCB [...] Claimant had not left his sphere of employment'. Subsequently referred to the Commissioner by the Insurance Officer as the legal interpretation of whether claimant was 'disentangled [...] from work' was deemed unclear, or whether the accident did or 'did not arise out of and in the course of the claimant's employment'. The Commissioner upheld the Insurance Officer's appeal, stating 'It cannot truly be said of him [the claimant] that he was entitled to be at the scene of his accident by reason only of his employment'.
