Further information: Gregory had slipped on a sleeper and twisted his knee. The knee was described as 'grossly arthritic' by the Medical Officer 'I consider incapacity due to osteo-arthritis and vascular changes consistent with age. Incapacity is therefore NOT due to accident described'. Despite Mr Parkin for the NUM describing Gregory's good work record and ability to construct a 600 yd allotment ('gardener for 45 years') the appeal failed.
