Description
Francis Earl of Newburgh (father of Lady Radcliffe), bequeathed £10,000 for his 3 younger children; Lady Radcliffe and her two siblings.
The award to the estate from this case was to be divided as follows:
1/3 £937 18s 8d to Rev T Sing as executor for Francis Earl of Newbrough (Lady Radcliffe's brother) and
2/3 £1,875 7s 4d to Mr Morgan, surviving trustee for the Roman Catholic School. However, this sum and a moiety of the personal estate charged in land could not be used for charitable purposes, but had to go to the next of kin.
Col Leslie executors for Lady Dorothy Leslie and Rev F Collingbridge, executor for Lady Barbara Eyre agree to waive their claims in favour of the school. A school already existed in Brighton supported by the Roman Catholic clergy and administered by the Sisters of Mercy, the Bishop of Southwark suggests that the legacy might be used to help in the payment of the mortgage, but the terms of the will prohibited this action.
