TitleLease and release by Samuel Waterhouse to Samuel Daniel of Stockport, Cheshire, grocer, Daniel Tymm of Edale, yeoman, John Lingard of Bowden Head, yeoman, John Robinson of Yeardsley-cum-Whaley, yeoman and Robert Heginbotham of Great Hamlet, yeoman. The premises conveyed are in mortgage to William Heginbotham and Waterhouse is indebted in considerable sums of money to Daniel Tymm, Elizabeth Marriott, Joseph Heginbotham, Henry Hesketh, Thomas Dakin and others at Hayfield known as the King's Head or Queen's Head, a messuage at Phoside known as Upper Smith Fold with closes known as Will Meadow, Over Field and Hill Croft, a messuage known as Lower Smith Fold or Bennetts Tenement, at Phoside, with Stone Shee Close, the Meadow and a moiety of Smith Fold, two closes called Brownlow Top and the Cowman Half Acre at Phoside, upon trust to sell the premises for the best price, to pay the £528 owing to William Heginbotham, than to pay all debts due to Waterhouse's creditors and if there is any residue, to pay the same to Waterhouse, but if the money is not sufficient to pay the debts, to pay each creditor proportionally. Further bargain and sale by Waterhouse to Daniel and others for better securing payment of his debts, of a leasehold messuage at Hayfield, known as the George, for the remainder of the leasehold term, upon trust, if the above premises are insufficient, to sell the said messuage and apply the money to paying his debts. 17 & 18 Mar
