Title	Award of arbitration between Sir Francis Leake of Sutton and James Asheton of Kynwalmershe, by Robert Sytwell, Richard Newsem and John Bromeley, upon the advice of Francis Rodes of Grays Inn. Whereas Leake pretends title to Asheton's dwelling house by reason of a lease to him by Thomas Henfrey of Kynwalmarshe, which title seems doubtful: Asheton and heirs are to occupy the house without distubance and Leake releases all his claim to the same, save to an annual rent of a red rose. Whereas Asheton pretends title to 11/2 acres land in a close of Leake's called Brodeclose and demands a rent of 18d from a close of Leake's called Scorer Yarde, by reason of a conveyance to him by one Ward, which seems doubtful: Leake and his heirs to occupy the entire Brodclose without disturbance and the Scorer Yarde without any claim or demand from Asheton and Asheton releases all his claim to the premises. Whereas Asheton has divers suits pending against certain of Leake's tenants that is a replevy against Thomas Henfrey for taking a mare of Asheton's in the Brode Close; an action of trespass against Henfrey for taking away certain mirestones and against Godfrey Lacke, Thomas Henfrey, George Nedeham and Henry Turnor for taking away a load of oats, and whereas certain of Leake's tenants have actions pending against certain tenants and servants of Asheton, that is George Nedeham a replevy against Alexander Butler for taking a cow in Scorer Yarde; Thomas Henfrey a replevy against Butler for taking two kine in Urchin Hyll [Urchinhill] and Henfrey a replevy against John Allin for taking two mares in Clay Crofte; Asheton is not to prosecute his actions and Leake is to cause Henfrey and Nedeham to drop their actions. Whereas there has been a dispute between Leake and Asheton over the ownership of a mere or balk lying between their lands in the field of Kilwaldmershe: the said mere is to be occupied by both parties as it has been for 40 years past. 10 Oct, 6 Eliz.
