| Description | Reciting marriage settlement by lease and release dated 23, 24 December 1765, of Anthony Deane and Anna Sophia Whitmore, respectively only son and heir of Anthony Deane esquire and a daughter of Sir Thomas Whitmore, by which it was agreed that trustees should stand possessed of £10,000 upon trust to invest it and after the marriage to pay Anthony Deane the son the interest thereof and after his death to assign the £10,000 to his surviving children (other than an eldest or only surviving son);
the £10,000 was lent to Anthony Deane the son, who on 13 Oct. 1778, mortgaged premises in Suffolk to Sir Henry Bridgman (a trustee of Anthony Deane's marriage settlement) to secure the £10,000;
reciting also that on 25 November 1789, Suffolk lands were settled to raise, on the deaths of Anthony Deane the father and Anthony Deane the son, £6,000 for the daughters and younger sons of Anthony Deane the son by Anna Sophia;
that an appointment dated 3 May 1796 and made by Anthony Deane the son and Anna Sophie his wife, of the trust sums of £10,000 and £6,000, stated that there were 4 children of Anthony Deane's marriage, William, George Henry, Anna Sophia and Rosamond Amelia Holden;
that the appointment of 3 May 1796 was varied by an appointment dated 2 May 1803;
that both appointments were revoked by Anthony Deane and Anna Sophia his wife in an appointment dated 9 December 1803 by which it was appointed that trustees should stand (after the death of Anthony Deane) possessed of the £10,000 in trust for George Henry Deane and Anna Sophia Deane, the daughter, as to £8,000 for George Henry and as to £2,000 for Anna Sophia the daughter, and of the £6,000 in trust for Anna Sophia the daughter and Rosamond Amelia Holden, as to £4,000 for Anna Sophia and as to £2,000 for Rosamond Amelia;
and reciting that Anthony Deane died March 1811 leaving the Reverend William Deane his eldest son, and younger children George Henry, Anna Sophia and Rosamond Amelia Holden;
and reciting that by lease and release of 23, 24 March 1802, it was provided that, when William Deane should be in possession of the premises below mentioned, £16,000 might be raised by sale of premises in Suffolk, Monmouth, Middlesex and Hertfordshire in order to discharge payment of the sums of £10,000 and £6,000 for the portions of Anthony and Anna Sophia Deane's younger children;
lands in Monmouthshire, sufficient to raise £8,000 for the portion of George Henry Deane, were disposed of;
William Deane died 11 May 1818 leaving Anthony William Johnson Deane (then an infant) his only son;
further Monmouthshire property was sold to raise £2,000;
and reciting that Rosamond Amelia Holden died in August 1820 before her husband leaving 7 children besides her eldest son;
the Reverend Charles Holden died 19 December 1821, having appointed Francis Hurt and William Legh Clowes guardians of his infant children;
that as Rosamond predeceased her husband a doubt has arisen whether the £2,000 appointed in her favour has not devolved on George Henry Deane and his sister Anna Sophia, under the trusts of the settlement of 25 November 1789 and that George Henry and Anna Sophia Deane have agreed to relinquish all claim in the £2,000 for the benefit of the younger children of Charles and Rosamond Amelia Holden and witnessing that in consideration of £2,000 paid by parties 7. and 8. to parties 1. to 4., with the approbation of parties 5. and 6, parties 1. to 4. released and discharged 7. and 8. and the lands etc mentioned in the settlement of 25 November 1789 and the release of 24 March 1802 as were charged with the payment of which the £2,000 is part, and the lands etc of Anthony Deane and William Deane both deceased and now of Anthony W J Deane, from the sum of £2,000 limited and appointed to Rosamond Amelia Holden.
