TRANSLATION
Lines 1-3: To all Christ’s faithful to whom these present writings may have come: We Henry Berisforde of the town of Nottingham[?] [?] in the person of master William Holt, gentleman, and John Berisforde of the Middle Temple, London in the County of Middlesex, gentleman, give greeting in the eternal lord.
Lines 3-7: Know that we the said Henry and John so for and in consideration of one hundred pounds of good and lawful money of England to us by Richard Dale of Osmaston in the County of Derby, gentleman, and Ralph Stables, otherwise Baker, of Osmaston, husbandman, acknowledge ourselves to be fully satisfied by this payment and the said Richard and Ralph, their heirs and administrators, to be fully quit and discharged forever by these present writings.
Lines 7-10: In as much as the parties concerned are satisfied by the terms agreed as specified in this indenture made between us, the said Henry and John on the one part and the same Richard and Ralph on the other part, on the said day given, to have demised, sold, and this our present writing has confirmed by us and our heirs to the said Richard Dale and Ralph Stables, otherwise Baker, their heirs and assigns forever:
Lines 11-17: All that Close or pasture commonly called Castle Close or Castle Cherristone close or by any other name known to be called or taken as, lately in the tenure or occupation of William Frances Esq. deceased, or by his assigns, lying or being in the parish of (left blank) in the County of Derby, near the Cell or priory of Calke, lately dissolved, with all paths, hedgerows, liberties, commodities, easements, profits and emoluments of the same close or pasture with regard to or pertaining to the use or occupation of all the woods, under-woods, grove and trees whatsoever growing on the ways, or in the said close or pasture or in all and singular the premises with their appurtenances,
Lines 17-19: which the said Henry Berisforde and John Berisforde lately had as a perquisite and gift granted and confirmed in writing by the said William Frances, first declared and made clear by his charter and thence made over to us on 7th May in the 18th year of the reign of our lady Elizabeth [1575]
Lines 20-26: To Have and To Hold the said close or pasture etc. all and singular the said properties lying there, given and granted to the said Richard Dale and Ralph Stables, otherwise Baker, their heirs and assigns forever, to hold of the chief lords of that fee by the services owed and accustomed by law. And we, truly, the said Henry and John, our heirs and assigns, by these our present writings, warrant and in peace defend forever the said close or pasture etc. to the use of Richard and Ralph against all people. Know ye, furthermore, that we, the said Henry and John to have made, ordained…
