Description
reciting part of Thomas Lee’s will dated 12 July 1775, that he died possessed of a house in Winster in which he lived and used one part of it as a butcher’s shop, now in Jane’s possession, that Lee at his death owed Caldwell £123, for which Caldwell has started an action against Jane and in consideration of his stopping the action against her and to satisfy the debt, she has agreed to sell the messuage to Caldwell, that the house is valued at £155 subject to a mortgage to William Gregory of Hill House parish Youlgreave for £100 on which £7 10s is due as interest, which it is agreed Caldwell shall pay out of the purchase money and the remainder of the money he will retain to set off against the debt of £123 and the costs of suing for the same and witnessing that for £155 (£107 10s to discharge the mortgage and £47 10s to pay off part of Lee’s debt to Caldwell) and for 10s paid to Jane, Jane released to Caldwell messuage, dwelling house or tenement and shop late inhabited by Lea standing at the west end of the Town Street of Winster adjoining on the back or northwardly side thereof to a yard called Moore’s Yard, on the south to the street, on the west to Richard Cadman’s smithy and on east to a narrow lane or foot road from Winster to Birchover and whereas several book debts were due to Lee amounting to £46 these are assigned to Caldwell toward paying the debt due him from Lee in consideration of the above and for 5s paid to Jane by Caldwell. Gives long list of debts with names and sums (usually under £1) including hackney saddle and ladder Dated 26 Oct Endorsed with livery of the message and of goods
