The claimant was incapacitated by Beat Knee from 8 September 1950 to 27 September 1950. The Medical Board decided, after a medical report dated 19/10/1950 that the loss of faculty was not 'permanent' or 'substantial.' It was assessed at 10 per cent final, from 28 September 1950. An Appeal Tribunal decision was made on 29 November 1950 which assessed the loss of faculty at 10 per cent for 8 months from 18 September 1950. There was also a Local Appeal Tribunal hearing on 3 January 1951 in respect of Special Hardship Allowance which was allowed. In the Evidence obtained at hearing it states 'I was a Packer at Shipley Colliery - There 20 years - Been a Packer for majority of 20 years [...] I hope to get back to Packing.' There is an appeal dated 20 June 1951 against a decision of 27 April 1951 awarding the extent of disablement at 2 per cent for life, which upholds the decision. |
