Further information: According to the Summary of facts on the Appeal referral, the claimant developed Industrial Dermatitis (prescribed disease number 24(b)) on 17 October 1956. Disablement benefit was paid from 17 April 1957 and the last award was a provisional assessment of 20 per cent. the Medical Board which examined the claimant on 1 April 1959 expressed the opinion that Mr Gee was likely to be permanently incapable of following his regular occupation. He was also in receipt of Special Hardship Allowance but following a review of 'notional earnings' special hardship was disallowed. There are details of earnings included in the paperwork, and a letter from the Compensation Agent dated 7 May 1959 advises the claimant what to say in the grounds of appeal. In the Insurance Officer's submission it states 'The evidence now available shows that the claimant's average weekly earnings as a general repairer (£18. 17s. 0d.) compare favourably with his notional earnings as a composite miner (£18. 0s. 0d))' The tribunal hearing was adjourned on 28 May 1959 for further information about wages and a letter dated 8 June 1959 to the claimant from the Compensation Agent advises the claimant that his current wages are higher than his regular occupation, and states 'I would therefore like your observations as to whether any useful purpose could be served in pursuing your case.' The hearing went ahead on 16 July 1959 but the appeal was disallowed.
