TitleAward in the dispute between Robert Swyfte, esq. and Alice Worsley als Smyth, daughter of John Worsley als. Smyth decd. , concerning a tenement in Kynnalmarshe, late of the inheritance of John Worsley als, Smyth - whereas the title of Alice is in tail upon condition, which condition, if broken, might give cause of entry by Swyfte who has brought the reversion of the fee simple of the premises, part of the cause of the suit being that it was thought the condition was not performed - and whereas Swyfte has for 21/2 years taken the rents and profits of the tenement - it is ordered by the mediation of Sir Edmund Molyneax and Antony Foster that there is to be no more business between the parties concerning the premises - Swyfte is to pay Alice £8-15-8d. for arrears of rent and is not to vex her further - as it is thought that Swyfte and his heirs may have much profit from the coal and ironstone within the premises, and so that Alice and the heirs of her body may have annual benefit from the tenement, Swyfte is to hold the tenement from henceforth and, as the yearly profits were not worth more than £5 to Alice, Swyfte shall grant her an annuity of £5-6-8d. 20 Oct, 2 Ed.
