DescriptionBy the common law an ancient highway could not be changed without the King's licence, first obtained under a writ of ad quod damnum. Highways have however been stopped and diverted under a succession of Acts: that of 13 Geo III c 78 (1773) placed the power of stopping and diverting highways, bridleways and footways, with the consent of landowners, in the hands of the justices.
The documents listed begin in 1773 with an inquisition in response to a writ of ad quod damnum and continue with orders and certificates under the Act of 1773 and subsequent Acts. The files numbered Q/SB/9/579-580 were created under the 1835 Highway Act and those numbered Q/SB/8/581-600 under section 108 of the 1959 Highway Act.

Early files consist of orders made by justices on viewing the roads concerned, consents of owners of land affected, plans and certificates that the new stretches of road are fit to be used. Later files contain certificates of the local justices' opinion that the diversion/closure would be of benefit and the reasons for their opinion, consents of owners of land affected, plans and other supporting papers. The listing of these files only refers to the orders, but it is intended to convey that other documents such as those described earlier in this paragraph are included with the order. Unless indicated otherwise there is a plan in each file.
