DescriptionReciting the marriage settlement on his marriage with Mary daughter of Robert Holden of Aston esquire made 12, 13 May 1742 between 1. Richard Shuttleworth esquire (father of James) since deceased, James his eldest son, the testator of the will, 2. Robert Holden of Aston esquire and Mary his daughter and only child 3. Edmund Starkey esquire and Thomas Starkey gentleman 4 Sir Robert Burdett Bart and Lancelot Rolleston esquire since deceased 5. Charles Jennens the younger eldest son of Charles the elder of Copshall, county Leicester, esquire and Robert Holden the younger eldest son of Alexander Holden of Newark, county Nottingham esquire 6. Reverend Samuel Pole Rector of Mugginton and Reverend John Rolleston Rector of Aston, in which properties in counties of Lancaster, York, Leicester and Westmorland belonging to Richard father of James Shuttleworth and to James, were settled to use of James for life, then that Mary should have £1,500 a year out of the premises, then to trustees for a term of 400 years from James' death upon trust for the sons of James and Mary with divers remainders over and to raise £15,000 for the portions of the younger children, reciting that James has children Robert the eldest son, James Holden, William Shuttleworth, Charles Shuttleworth, Mary wife of Charles Turner of Kirkleatham esquire and Elizabeth Shuttleworth and, in exercise of the authority reserved to the testator in the settlement recited, appointing the trustees of the settlement, Charles Jennens the younger and Robert Holden the younger after £15,000 shall be raised, to pay the younger children £3,000 each, refering to the marriage settlement dated 28 September 1771 of Mary Shuttleworth and Charles Turner, and directing that Elizabeth's £3,000 should be paid her at 21 or on her marriage;
devised to wife Mary leasehold messuage and lands in Downing Street and Fludyer Street in City of Westminster, for life, then to his son Robert, to wife Mary her jewels and paraphenalia, best coach and harness, all coach horses, 3 of his saddle-horses at choice, household goods, linen, china, furniture and stock in cellars in house in City of Westminster and house at Aston upon Trent and in offices and gardens of them, to son Robert all household goods, linen, pictures, furniture, and all plate everywhere (except pieces of plate which belonged to Robert Holden esquire deceased) and stock in or about houses, park, gardens or lands in testator's occupation at Gawthorp and Barton Lodge, county Lancaster, and at Forsett county York;
to wife £100, son James ?£50, son William £500, son Charles £300, daughter Elizabeth £3,000 at 21 or marriage;
real estate to son Robert, who is named executor
