| Title | Draft conveyance by (1) John Booth of Stoney Middleton, gentleman, (as mortgagee); and (2) Peter Furness of Eyam, lime burner; to (3) James Furness of Hucklow, farmer; with the consent of (4) Robert Gill of Hucklow, farmer;- reciting a lease and release of 9/10 Mar 1834 by Josiah Birley, with Peter Furness and Hannah, his wife, to John Booth, miller, of the premises, as a mortgage for £160 plus interest; and a mortgage of 21 Apr 1834 by Peter Furness to Thomas Gregory of the hereditaments in the second schedule for £27 plus interest which was paid by (1) at the request of (2) on 29 Dec 1840; and that John Booth, miller, died in Jan 1845 and by his will dated 22 Jun 1843 appointed his sons John (1), and Charles as executors, proved 10 Apr 1845 with bequests to his eldest son, James Booth of Stoney Middleton, gentleman, who died a bachelor in 1853, so that (1) is the eldest surviving son, and Charles Booth is now in Australia; - consideration of £200 paid by (3) (including £196 10s to (1)), (2) hereby conveys to (3) property at Eyam, namely: First Schedule: Brightly Closes 2 acres, Ellenor in step 1 acre, formerly occupied by Joseph and Peter Furness, and now by Peter Furness; Second Schedule: The Rood 1r 5p, formerly in the possession of Joseph Unwin, afterwards of Edward Unwin, then of Thomas Benson, and now of Peter Furness 9 Dec 1853 Appended is a declaration by James and Peter Furness that they refuse to have Mr Gregory made a party to this deed or informed of it although he has an interest in The Rood |
