| Description | Reciting lease and release of 17/18 May 1676 [lease D547M/T210] between i) Everingham Cressey ii) Elizabeth Taylor, then Shipman, gentlewoman, of St. Martin in the Fields, and iii) John Tate, later Sir John Tate, Henry Crooke, citizen and linen draper, of London, Thomas Cressey and Luke Robinson, both of Grays Inn (all since deceased), by which Everingham bargained and sold to John and Henry the manor of Birkin (Yorks) with Birkin (Yorks) hall, with lands (by name and tenant), to use of Everingham for life, without impeachment of waste, remainder (apart from lands limited for use of jointure of Elizabeth Taylor for life) to John and Henry for 500 years without impeachment of waste, in trust that in case £2000 (secured by marriage settlement of 19 Sept. 1670 [D547M/T202], on a term of 40 years, to Dorothy, eldest daughter of Everingham) and £700 with interest (for which some lands limited for jointure of Elizabeth were mortgaged to Samuel Tierman) should be paid after death of Everingham and during life of Elizabeth, then John and Henry should raise the £2000 with intent to free lands limited for jointure of Elizabeth from incumbrance of £2,000, term of 40 years and mortgage for £700, and after decease of Elizabeth, Henry and John's term of 500 years to determine; recites also that sums of £2,000 and £700 are still due, so that, in consideration of £1200, Richard and Elizabeth lease to William all lands in above indenture limited for term of 500 yrs., for remainder of that term. |
