| Title | Articles of agreement made between 1 John Shallcross of Shallcross esq. 2 William Carrington of Ashen Clough, William Bennett of Whitehough and John Mottram of Horridge. Recites that Shallcross on 1 May 1711 leased to Carrington, Bennett and Mottram, his interest in coal and coalmines in Bowden Middlecale for 20 years, that the lessees fear their title to coal under the freehold part of the commons and encroachments, granted in the lease as well as those under the Queen’s part of the same, may be disputed. Agree that 2 will pay one third of any legal charges in defence of 1’s defence of the title and that if 2 are deprived of the freeholders’ and tenants’ part of the premises, 1 will release them of half of their rent and he will pay any damages recovered from them. |
