Further information: The Appeal paper is dated 10 December 1951 but there is no date given for the Tribunal. Smith suffered a lacerated leg in the accideent which was stitched up and he then returned to work. In August 1951 the wound was opened up again for the removal of a piece of stone 'the size of a nutmeg' in Heanor Hospital and he then returned to work 17 September 1951. The Medical Board in September 1951 had decided a temporary loss of faculty at less than 20 per cent. The appeal which was endorsed by the Heanor GP who said: 'I consider he is entitled to disablement benefit instead of the sick pay he has received'.
