Further information: Miners Nystagmus given as cause of incapacity from December 1948. Medical Board report in June 1949 states 'Unfit for work down coal mine then by June 1951 'No longer suffering from Miners Nystagmus [...] If he has the will or the incentive to work below he would be able to return to work underground [...] but [...] Bright lights should worry him for a long time to come'. One eyed man who has an artifical left eye, noted on opthalmic report: 'wearing well fitted and well matched prosthesis (of private manufacture)'. Working on as a surface labourer. Tribunal noted that because the eye is un-injured, the 'rule of paired organs' in the Benefit Regulations does not apply. Burrows requested further advice following the appeal, as to whether to accept the £45 settlement and what his rights were. NUM response to Branch official states: 'This man was awarded a 5 per cent gratuity for life, which is £45.[...] there is no alternative but to accept the £45. Of course that carries with it the pecial Hardship allowance, providing the man has not returned to his own job or a job of equivalent standard.' |
