Title
Medical Appeal Tribunal case file for George Harte, aged 54, Ripper at Glapwell, relating to an Industrial Accident
Date
1950
Description
Date of birth: 05/01/1895
Marital status: Not given
Address: The Blocks, Stonebroom
Type of injury: Injuries - bruised back; fractured finger
Description of accident: Slipped and fell down the 'clean entrance' steps (in the Pithead baths)
Further information: Injury benefit claim to Local Tribunal. Harte slippped when leaving pit head baths on 6 May 1949; in his statement dated 17 May 1949 he says he 'was leaving clean entrance wearing pit boots because it was a shorter way to the Ambulance Room where he was going to have treatment for a small wound on hand.' He also states that 'It was not uncommon for workmen to use that entrance wearing pit boots.' Employer's letter states' notices are posted up in the pit head baths that workmen should not leave by the clean way when wearing pit boots as these steps have not been rendered skid-proof'. Appeal made against decision that 'the accident was not an industrial accident'. In a previous case, noted that the use of the baths is incidental to the employment. It is noted that the shift ended at 2.30 p.m., and that the accident happened at 3.15p.m. There is no appeal tribunal paperwork, but there is an undated handwritten note, likely to have been written by Joseph Kitts, the Area Compensation Agent, which states 'in mans favour'.
