According to the Appeal referral, the claimant was paid sickness benefit from 2 June 1959 to 13 June 1959, certified as 'General Debility.' After this dated he was reminded he need to send in further medical certificates if he wanted to continue with his claim. His reason for the delay in returning the certificates was that 'his son had taken him to France for a holiday from 15 June 1959 to 7 July 1959. The claimant was denied sickness benefit from 16 June 1959 to 7 July 1959 'on the ground that his temporary absence from Great Britain was not for the specific purpose of being treated for incapacity which commenced before he left Great Britain.' In the claimant's grounds for appeal it is stated 'my doctor informed me that I required complete rest and change. My son who resides in France learning of my illness invited my mother to persuade me to go. This was done with the full knowledge of my doctor.' A handwritten note states 'Against?' |
