According to the Summary of facts on the Appeal referral, the claimant had been receiving disablement pension due to pneumoconiosis from 23 October 1957. He was continuously incapable of work from 27 October 1958 and on 13 November 1958 he became an in-patient in hospital until 12 December 1958. On 23 December the consultant physician at the hospital certified that the treatment the claimant received was not for pneumoconiosis. A decision was made by the Insurance Officer that the degree of disablement could not be treated as if it had been assessed at 100 per cent as the claimant was not receiving treatment for the relevant loss of faculty. The claimant appealed and the tribunal found in favour on 26 February 1959. |
